1. Acceptance of Terms

By accessing or using the services of BD Driving School, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all students, parents/guardians, and visitors to our website.

2. Service Description

BD Driving School provides driver education and training services in Winnipeg, Manitoba, including but not limited to:

• In-car driving instruction
• Classroom theory sessions
• Winter driving training
• Road test preparation
• Refresher courses

All services are provided in accordance with Manitoba Public Insurance (MPI) standards and Manitoba traffic laws.

3. Eligibility and Requirements

Age Requirements

• Students must be at least 15 years old (or as required by Manitoba law)
• Students under 18 require parental or guardian consent
• Valid learner's permit or driver's license must be presented before lessons

Health and Safety

• Students must be in good physical and mental health to operate a vehicle
• Any medical conditions that may affect driving ability must be disclosed
• Students must not be under the influence of alcohol or drugs during lessons

4. Booking and Scheduling

• Lessons must be booked in advance and are subject to instructor availability
• We will make reasonable efforts to accommodate your preferred schedule
• Lesson times are approximate and may be adjusted based on traffic and weather conditions
• Pick-up and drop-off locations must be within our service area in Winnipeg

5. Cancellation and Rescheduling Policy

Student Cancellations

• 24+ hours notice: Full refund or reschedule at no charge
• Less than 24 hours: 50% lesson fee charged
• No-show: Full lesson fee charged
• Emergency situations will be considered on a case-by-case basis

Instructor Cancellations

If we need to cancel or reschedule a lesson, we will provide as much notice as possible and offer alternative times or a full refund.

6. Payment Terms

• Payment is due at the time of booking unless other arrangements are made
• We accept cash, e-transfer, and major credit cards
• Package purchases are non-refundable but may be transferred to another student
• Lesson packages must be used within one year of purchase
• All prices are in Canadian dollars and include GST
• Prices are subject to change with 30 days notice

7. Student Conduct and Responsibilities

Students are expected to:

• Follow all traffic laws and instructor directions
• Treat instructors and vehicles with respect
• Arrive on time for scheduled lessons
• Bring required documents (learner's permit, ID)
• Notify us immediately of any changes in contact information
• Report any vehicle damage or incidents immediately

We reserve the right to refuse service or terminate lessons for inappropriate behavior, safety violations, or failure to comply with these terms.

8. Liability and Insurance

• Our vehicles are fully insured as required by Manitoba law
• Students are covered under our insurance during lessons
• Students are responsible for any damage caused by negligence or willful misconduct
• We are not liable for personal belongings left in vehicles
• Students participate in lessons at their own risk

9. Weather and Road Conditions

Lessons may be cancelled or modified due to severe weather or unsafe road conditions. In such cases, lessons will be rescheduled at no additional charge. Manitoba winter driving training may proceed in moderate winter conditions for instructional purposes.

10. No Guarantee of Results

While we strive to provide excellent instruction, we cannot guarantee that any student will pass their road test. Test results depend on individual performance and the examining officer's assessment. We recommend students practice adequate hours before attempting their road test.

11. Intellectual Property

All materials provided during lessons, including handouts and online resources, are the property of BD Driving School and may not be reproduced or distributed without permission.

12. Privacy and Data Protection

Your personal information will be handled in accordance with our Privacy Policy and applicable Canadian privacy laws. We collect and use your information only as necessary to provide our services and meet legal requirements.

13. Dispute Resolution

Any disputes arising from these terms or our services will be governed by the laws of Manitoba and Canada. We encourage students to contact us directly to resolve any concerns before pursuing legal action.

14. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new terms.

15. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
